A local man was convicted on a plea to guilty of misdemeanor driving with a blood alcohol level of .08 grams or higher, while the first count against him, driving under the influence, was dismissed.

Rob Richard Rutherford, 56, of Idyllwild was arrested on both May 14, 2014 and May 19, 2014, on the same charges, the second of which involved a solo traffic collision with no injuries.

Rutherford must be committed to the custody of the sheriff for 60 days, and must, at his own expense, enroll and complete a drinking driver program, the electronic monitoring (ankle bracelet) program, and the secure continuous remote alcohol monitor (SCRAM) program, pay a fine of $1,949, not drive within six hours of consuming any alcohol or drugs, and comply with other terms and conditions during a 48-month probation period.
