In our July 14 edition, we reported on a number of traffic incidents. The reports were taken directly from narratives provided to us by California Highway Patrol Public Information Officer Darren Meyer, San Gorgonio Pass Station, and are based on CHP officer on-scene reports.<\/p>\n
In one, based on Meyer\u2019s reading of the officer\u2019s account, we reported that Christina Sabo was \u201ccited for driving under the influence, but not for alcohol.\u201d She indicated that she was on her way to dialysis treatment at the time. <\/p>\n
Sabo has provided the Town Crier a CHP form 103, Certificate of Release From Custody, dated Dec. 8, 2016, stating that \u201cthe individual named as the \u2018detained person\u2019 was detained only, not arrested, and was released pursuant to provision of paragraph (1) or (3) of subdivision (b) of Penal Code Section 849 and other related subsections.\u201d<\/p>\n
As a result of her release, Sabo was not brought before a magistrate or charged with being under the influence. <\/p>\n
Under the relevant sections, a peace officer may release from custody any person \u201carrested without a warrant\u201d whenever: (1) \u201cHe or she is satisfied that there are insufficient grounds for making a criminal complaint against the person arrested;\u201d or (3) \u201cThe person was arrested only for being under the influence of a controlled substance or drug and such person is delivered to a facility or hospital for treatment and no further proceedings are desirable.\u201d<\/p>\n
According to the release certificate, a record of arrest and release as defined above shall be deemed \u201ca detention and not an arrest.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"
