A possible trial start date in the case against Marcus Green has been moved to Oct. 24.

Green, 54, of Thermal, was the driver of a car that went over the side of Highway 74 in May 2016 and resulted in the death of a 5-month-old child. The Riverside County District Attorney’s Office filed two felony charges — murder and willful child cruelty — as well as gross domestic violence.

In April, Green’s attorney, Michael Rowlands, deputy public defender, filed a motion to set aside the indictment because of irregularities when he was initially charged. However, in June, Judge Dean Benjamini ruled against the defense motion and set the original trial date for July. This is the third postponement.
