Nasir David Powell’s felony settlement conference, set for April 6, was rescheduled for April 26, again at 8:30 a.m. in Department S204, Murrieta. It was the second time his FSC has been continued.
Powell, 18, is charged with five felony counts involving various sexual activities with minors ranging in age from 14 to 17 years of age. Although he claimed to investigators that all said activities were consensual, that cannot operate as an exonerating defense because they were all with minors. As a matter of law, minors are not capable of consenting to such activities, so lack of consent is not an element of these charges.
Four of the counts against Powell carry a maximum sentence of a year in county jail or state prison. One of the counts, dealing with a minor more than three years younger than himself, is punishable by either a year in county jail or as much as three years in state prison.
